Terms of Service

1. Who we are. LuxAbility is a media and document accessibility scanning service operated by Stelnyx ("we", "us"). These terms govern your use of luxability.app and any audit, report, or monitoring service we provide.

2. The service. We crawl publicly reachable pages and assets of the domain you designate, evaluate them against WCAG 2.1 using deterministic, versioned rules, and deliver a scored report. Scores are reproducible for a given rule version: same input, same score.

3. Authorization. By submitting a domain, you represent that you own it or are authorized to request a scan of it. We only access publicly reachable content and respect robots directives where technically applicable.

4. Not legal advice. Our reports describe technical conformance findings against WCAG 2.1. They are not legal advice, a legal conformance certification, or a guarantee of compliance with the ADA, the European Accessibility Act, Section 508, or any other law. Consult qualified counsel for legal determinations.

5. Scope and limits of findings. A report reflects the assets reachable at scan time and the rule version applied. We separate verified facts from heuristics in the report itself. A high score does not guarantee accessibility for every user, and a scan cannot detect issues in content we cannot reach.

6. Payment and delivery. One-time audits are quoted by asset count and delivered within 5 business days of scan completion. Fees are due as invoiced. Re-scans and monitoring are billed as listed on the site or in your order.

7. Your report, our engine. You own your report and may share it freely, including with counsel, auditors, and vendors. We retain all rights to the scanning engine, rule sets, scoring methodology, and site content.

8. Acceptable use. Don't use the service to scan domains you're not authorized to scan, probe or disrupt our infrastructure, or resell reports as your own product without a written agreement.

9. Disclaimer and liability cap. The service is provided "as is". To the maximum extent permitted by law, our total liability arising from the service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect or consequential damages, including legal claims brought against you by third parties.

10. Changes. We may update these terms; material changes will be posted here with a new effective date. Continued use after changes means acceptance.
